The terms “we,” “us,” and “our” refer to Bark Sphere. Bark Sphere operates the online store available at barksphere.com, including all related information, content, functions, products, tools and services offered through the website (collectively, the “Services”).
Our store is powered by Shopify, which provides the e-commerce platform that enables us to offer the Services to you.
These Terms of Service, together with any policies referred to in them, explain your rights and responsibilities when accessing our website or purchasing products from Bark Sphere.
Please read these Terms carefully. By visiting, interacting with or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not access or use the Services.

An automatic order-confirmation email confirms that we received your order, but it does not necessarily mean that the order has been accepted or dispatched.

- Pricing or product information contains an obvious error
- Payment cannot be authorised
- Fraudulent or unauthorised activity is suspected
- Delivery cannot be completed to the address provided
- The order violates these Terms or applicable law
- The order appears intended for unauthorised commercial resale
If we cancel an order after receiving payment, we will refund the relevant amount to the original payment method.
Please review your order carefully before submitting it. Once processing or fulfilment has started, we may be unable to cancel or modify it.

Products purchased through Bark Sphere are intended for personal or household use unless otherwise agreed in writing.

Prices are displayed on the website in the currency shown during your shopping session or checkout.
Prices, discounts and promotions may change without notice. The price charged will be the price displayed and confirmed at the time your order is submitted, subject to correction of obvious pricing errors.
Unless expressly stated otherwise, product prices may not include:

Any applicable delivery cost will be displayed during checkout where available.

- You will pay all amounts properly charged for the order
Payments may be processed through Shopify Payments or another authorised payment provider displayed at checkout.
Bark Sphere does not directly store full payment-card numbers or card security codes.
Payment providers, card issuers and banks may conduct additional verification or fraud-prevention checks before approving a payment.
Section 5 — Discounts and Promotions
Discount codes and promotional offers:
- Are valid only for the stated period
- May be limited to specific products, customers or regions
- May require a minimum purchase
- May not be combined unless expressly permitted
- Have no cash value
- Cannot be applied retrospectively to completed purchases
- May be cancelled where obtained or used fraudulently
Where promotional terms conflict with these Terms, the specific promotional terms will apply to the promotion.
Section 6 — Shipping and Delivery
We will arrange delivery to the shipping address provided during checkout.
Customers are responsible for providing a complete and accurate address. We are not responsible for delivery problems caused by incorrect, incomplete or outdated information supplied by the customer.
Delivery dates and transit times are estimates unless expressly stated otherwise. Delays may occur because of:
- Courier or postal-service disruption
- Customs inspections
- Public holidays
- Severe weather
- High seasonal demand
- Incorrect delivery information
- Remote-area delivery conditions
- Events beyond our reasonable control
Tracking information may take time to become active after the shipping label is created.
For consumers located in jurisdictions where mandatory consumer law applies, the risk of loss or damage remains with Bark Sphere until the products are physically delivered to you or to a person designated by you, except where you independently selected a carrier that was not offered by us.
You should contact us promptly if:
- Your parcel is significantly delayed
- Tracking shows delivery but the parcel was not received
- The parcel arrives visibly damaged
- You receive an incorrect or incomplete order

Section 7 — Returns, Refunds and Exchanges
Returns, refunds, exchanges, damaged products and order cancellations are governed by our Return and Refund Policy.

Customers in the European Union may also have a statutory 14-day right of withdrawal, subject to applicable exceptions.

Bark Sphere is powered by Shopify, which enables us to provide the Services.
However, purchases made through barksphere.com are transactions directly between the customer and Bark Sphere.
Bark Sphere, rather than Shopify, is responsible for:
- Product listings
- Order fulfilment
- Customer service
- Returns and refunds
- Compliance with applicable consumer law
- The products offered through the store
Shopify is not the seller of the products displayed on Bark Sphere.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for injury, loss, damage or claims arising directly from products purchased from Bark Sphere.
Nothing in this section excludes responsibilities that cannot lawfully be excluded.
Section 13 — Privacy
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, Shopify collects and processes certain information relating to access, checkout, payments, security and the use of the Services.
Information may also be processed by payment providers, fulfilment partners, logistics companies and other service providers necessary to complete transactions and provide the Services.

Where you submit a review, comment, suggestion, photograph, message or other content to us, you confirm that:

- The content is not unlawful, misleading, abusive or defamatory
- Any incentive received in connection with the submission has been disclosed
You grant Bark Sphere a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, translate and display that content for purposes connected with operating, improving and promoting the Services.
This licence does not transfer ownership of your content to Bark Sphere.

We are not required to publish or respond to every submission.

Where you are acting as a consumer, we remain responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses caused exclusively by:
- Incorrect information supplied by the customer
- Unauthorised use of a customer’s account where we were not at fault
- Independent actions of third-party services outside our reasonable control
- Events beyond our reasonable control
- Business losses where the products were purchased solely for personal use
This section applies only to the extent permitted by applicable law.
Section 20 — Indemnification
Where permitted by law, you agree to compensate Bark Sphere for reasonable losses, liabilities or costs resulting directly from:
- Your material breach of these Terms
- Your unlawful use of the Services
- Your infringement of another person’s legal rights
- Fraudulent or malicious activity carried out through your account
This provision does not apply to losses caused by Bark Sphere’s own breach, negligence or unlawful conduct and does not limit mandatory consumer rights.
Section 21 — Events Beyond Our Control
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including:
- Natural disasters
- Severe weather
- War, terrorism or civil unrest
- Government actions
- Customs disruption
- Strikes or transport interruptions
- Epidemics or public-health emergencies
- Internet, telecommunications or power failures
- Courier or supply-chain disruption
Where such an event materially affects an order, we will take reasonable steps to minimise the effect and communicate with the customer.
Mandatory rights concerning delayed or undelivered goods remain unaffected.
Section 22 — Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in full force and effect.
Section 23 — No Waiver
If we do not immediately enforce a right or remedy under these Terms, that does not mean we have waived it.
A waiver is effective only where expressly confirmed in writing.
Section 24 — Entire Agreement
These Terms, together with the policies expressly incorporated into them, constitute the agreement between you and Bark Sphere regarding use of the Services.

Nothing in this section excludes representations or rights that cannot legally be excluded.

Section 26 — Governing Law
These Terms and purchases made through Bark Sphere are governed by the laws of Italy, without prejudice to any mandatory consumer protections available under the laws of the country in which you habitually reside.
Where you are a consumer in the European Union, you may bring proceedings before the courts available under applicable consumer-protection and jurisdiction rules.
Nothing in this section prevents the parties from seeking an amicable resolution before commencing formal proceedings.
Section 27 — Changes to These Terms
We may update these Terms from time to time to reflect:

- Changes to Shopify functionality
- Legal or regulatory requirements
- Operational or security developments
- Changes to our policies or service providers
The latest version will be published on barksphere.com, together with the updated revision date.
Changes will not retroactively reduce rights relating to orders already accepted unless required by law.
